1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your access to and use of The Easy Button website located at easybutton.vote (the “Site”) and any contributions made through the Site. By accessing the Site or making a contribution, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, please do not use the Site or make a contribution. We reserve the right to update these Terms at any time. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
2. About The Easy Button
The Easy Button Fund is a pro-democracy giving initiative that enables donors to support a curated slate of state-level candidates and organizations — including governors, attorneys general, secretaries of state, state courts, and state legislators — across key battleground states. With one donation, your contribution is split proportionally across the recommended slate of 14 candidates and 2 PACs.
Paid for by The Easy Button Fund. Not authorized by any candidate or candidate’s committee. Contributions are not tax-deductible.
3. Eligibility to Contribute
By making a contribution through the Site, you represent and warrant that:
- You are a U.S. citizen or lawfully admitted permanent resident of the United States;
- You are at least 18 years of age (or the age of majority in your state of residence);
- You are making the contribution with your own personal funds and not those of another person or entity;
- You are not a corporation, labor union, foreign national, federal contractor, or other entity prohibited from making political contributions under applicable law;
- The contribution is not being made on behalf of another person or entity;
- You are not using funds provided by a foreign national or foreign government;
- You have the legal authority to authorize the transaction from the account or card you use.
Federal law prohibits contributions from foreign nationals, corporations, labor organizations, and federal contractors. Making a false contribution statement may subject you to civil and criminal penalties.
4. Contributions and Payment
4.1 How Contributions Work
When you make a contribution through the Site, your donation is split proportionally across the current recommended slate of candidates and PACs, up to the legally permitted maximum for each recipient. The slate composition and recommended amounts are subject to change without notice as the election landscape evolves.
4.2 Contribution Limits
Political contributions are subject to legal limits under federal and applicable state campaign finance laws. By contributing, you agree not to exceed these limits. The Easy Button will allocate contributions in accordance with applicable limits, and any amount that would exceed a recipient’s legal limit may be returned to you or reallocated.
4.3 Non-Refundable
All contributions are generally non-refundable once processed, as they are distributed to candidate committees and PACs. If you believe an error occurred in processing your contribution, please contact us promptly at the contact information in Section 14. Refund requests will be evaluated on a case-by-case basis in compliance with applicable campaign finance regulations.
4.4 Payment Processing
Contributions are processed securely through Democracy Engine, our third-party payment processor. By submitting payment information, you authorize Democracy Engine to charge your selected payment method for the contribution amount. Your payment data is handled in accordance with Democracy Engine’s terms of service and privacy policy, and is subject to PCI DSS security standards.
4.5 Receipts and Reporting
You will receive an email receipt for your contribution. As required by campaign finance law, certain donor information (including name, address, employer, and occupation for contributions above applicable thresholds) will be reported to the Federal Election Commission (FEC) and/or relevant state election authorities and will become part of the public record.
5. Candidate Slate and PAC Allocations
The Easy Button curates its slate based on research into which state offices matter most for protecting free and fair elections. The current slate covers battleground states including Arizona, Georgia, Michigan, Nevada, North Carolina, Wisconsin, and Pennsylvania.
We reserve the right to add, remove, or adjust candidates and PAC allocations on the slate at any time, including due to candidate withdrawal, disqualification, or changed strategic priorities. We are not responsible for the actions, statements, or conduct of any candidate or organization that receives contributions through the Site.
Allied organizations currently on the slate include The Justice Project PAC and PAC for America’s Future. These organizations operate independently and are not controlled by The Easy Button Fund.
6. Contributions Are Not Tax-Deductible
Contributions made through The Easy Button are political contributions and are NOT tax-deductible as charitable contributions for federal or state income tax purposes. Please consult a qualified tax advisor if you have questions about the tax treatment of political contributions.
7. Use of the Site
7.1 Permitted Use
You may use the Site only for lawful purposes and in accordance with these Terms. You agree to use the Site solely to make personal political contributions and to access information about The Easy Button and the candidate slate.
7.2 Prohibited Conduct
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation;
- Make contributions on behalf of another person, entity, or using another person’s funds without their explicit authorization;
- Attempt to circumvent contribution limits or campaign finance laws;
- Use automated tools, bots, or scripts to access or interact with the Site;
- Attempt to gain unauthorized access to any part of the Site or its underlying infrastructure;
- Submit false, misleading, or fraudulent information;
- Interfere with or disrupt the Site or servers or networks connected to the Site;
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
8. Intellectual Property
All content on the Site — including text, graphics, logos, images, data, and software — is the property of The Easy Button Fund or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the Site without our prior written permission.
You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes in accordance with these Terms.
9. Third-Party Links and Services
The Site may contain links to candidate websites, PAC websites, Democracy Engine, and other third-party platforms. These links are provided for your convenience only. We do not endorse, control, or take responsibility for the content, privacy practices, or terms of any third-party sites. Your interactions with third-party sites are governed by their own terms and policies.
10. Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THE EASY BUTTON FUND DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee that contributions will achieve any particular electoral outcome. Strategic assessments and candidate recommendations represent our good-faith research and are not guarantees of election results.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE EASY BUTTON FUND, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR CONTRIBUTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT OF YOUR MOST RECENT CONTRIBUTION PROCESSED THROUGH THE SITE.
12. Indemnification
You agree to indemnify, defend, and hold harmless The Easy Button Fund and its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your use of the Site; (b) your contribution; (c) your violation of these Terms; (d) your violation of any applicable law or regulation, including campaign finance laws; or (e) any false representation you made in connection with your contribution.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the United States and the State of [Insert State], without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Site shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction where necessary to protect intellectual property rights or prevent irreparable harm.
You agree that any claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative action.
